Premium Membership
Terms & Conditions
1) PREMIUM MEMBERSHIP: This agreement forms a legally binding agreement between Member and HiClimb and governs Premium Member's extra amenity of a parking pass. Hereinafter, "you" and other third-person pronouns will refer to as Member. All standard memberships (Weekly, Monthly, Family, Annual, and Specialty Memberships) Terms and Conditions Apply. Access to the Premium Membership requires an active Weekly, Monthly, Family, Annual, or Specialty Membership.

2) PREMIUM MEMBERSHIP: The premium membership provides the following amenity to your existing HiClimb Membership: One (1) parking pass at the Diamond Parking structure located at 860 Halekauwila St., with possible entrances on Halekauwila St. and Ilaniwai St.

3) PARKING ACCESS AND USE: Member may access the parking facility anytime of day. Member may NOT share their parking pass card. Members must park on the third (3rd) floor or above.

4) PARKING PASS CARDS: The Parking Pass Cards are the property of HiClimb LLC. Only one (1) vehicle may be assigned per parking pass card. One (1) parking pass card will be issued per Premium Membership. Member may request an update to their assigned vehicle at anytime by emailing Support@HawaiiClimb.com.

Cards may not be duplicated.

The Parking Pass Card must be returned on the last day of the month that the membership is terminated. Any lost parking pass cards or failure to return a parking pass card by the end of the termination month will incur a nonrefundable $30 fee.

5) GARAGE FEES: Member is responsible for any fees in violation of the Diamond Parking facility rules. Rules are posted within the parking facility and on the Diamond Parking Contract. Violations and fees sent to HiClimb on behalf of the Member will be forwarded to the Member via their email on file and may result in additional charges from HiClimb to cover the violation. Violation of Diamond Parking rules may result in the termination of the Members Premium Membership.

6) BILLING CYCLE: Premium Membership Billing cycles begin on the first (1st) day of each month and ends on the final day of each month. Premium memberships may not be prorated and will be charged independently from standard membership billing cycles.

7) AUTOMATIC MONTHLY RENEWAL: Once premium membership is activated, HiClimb will automatically process payment for the next billing cycle and will continue to do so on the first (1st) of every month until Member terminates this contract.

8) TERMINATION OF CONTRACT: This contract may be terminated via phone, email, or in-person at the facility. HiClimb holds the right to terminate this contract at any time for any reason. Upon termination, the Member will enter the Termination Period which will end the final day of their current billing cycle which is the final day of the month in which the request is received. The Member will still have access to the parking benefits, until the end of their termination period. HiClimb reserves the right to cancel or shorten the Termination Period for any reason. The fees paid for this termination period are not prorated nor refundable. Upon completion of the termination period the member must return their issued Parking Pass Card to HiClimb via mail or in person by the last day of the month in which the membership is terminated. Passes not returned by the end of the terminating month will be subject to a lost card fee of $30.

The return address for Parking Pass Cards is as follows: HiClimb LLC, 825 Ilaniwai St, Honolulu, Hawaii, 96813, please include the name and email of the member to facilitate termination.

9) TRANSFER OF CONTRACT: The HiClimb Premium Membership contract may NOT be transferred or shared.

10) MEMBERSHIP FREEZE: There is no freezing or pausing of the Premium Membership. However, you can terminate your membership at any time without paying any fees. We cannot guarantee the availability when you return. Cards must be returned by the last day of the month of termination to avoid the nonrefundable $30 lost card fee.

11) LIMITED LICENSE: Member acknowledges and agrees that HiClimb's name, services, and any logos, designs, text, graphics, software, content, files, materials, and any other intellectual property rights contained therein, including without limitation, any copyrights, patents, trademarks, proprietary or other rights arising thereof, are owned by HiClimb LLC. Members agree they will not do anything inconsistent with HiClimb's ownership of all the intellectual property discussed herein. Member further agrees that there are no rights, title, or interest in or to any membership services, except as stated in this agreement.

12) REFUNDS: There will be no refunds after a Premium Membership has been paid.

13) MEMBER CONSENTS: Member agrees to hold HiClimb, its owners, affiliates, and representatives, harmless from any damage, tangible or intangible, that may happen to the Member while participating in Membership Services. Member agrees that HiClimb offers its membership program with no guarantee of results of any kind. Member Agrees that any results that occur during their membership, whether positive or negative, are the effects of Members own personal choices. Member agrees and verifies that all of the information they have given to HiClimb and its representatives is accurate, up to date, and without omission of any requested information. Member agrees to notify HiClimb of any changes or upcoming changes concerning their personal information.

14) DIAMOND PARKING AGREEMENT: Member agrees to complete a Diamond Parking Agreement to participate in the Premium Membership and to acknowledge and adhere to any rules or policies posted by Diamond Parking.

15) ASSUMPTION OF RISK: Member acknowledges that parking is at their own risk. Member agrees and understands that their participation in membership services may involve risks. These risks may lead to tangible or intangible harm to person or property and Member agrees that these risks may result not only from their own actions but also from the actions of others. With the knowledge and understanding of these risks, Member chooses, of their own will and volition, to continue participating in the premium membership program.

16) INDEMNIFICATION: HiClimb is NOT responsible for any damage or theft to Members personal property or vehicle while utilizing the Parking Pass Card or when utilizing the Diamond Parking facility. Member further agrees to defend and indemnify HiClimb and hold them harmless against any and all legal claims and demands, including reasonable attorney's fees, which may arise from or relate to Member's use or misuse of the activities, Member's breach of this agreement, or Member's conduct or actions. Member agrees that HiClimb shall be able to select its own legal counsel and may participate in its own defense if so desired.
